THE "GO TO" PLACE FOR ANYONE INTERESTED IN SPECIALTY FOOD MARKETING.

Hello. Here is my scenario: A caterer with his own professional kitchen has offered to fund and manufacture my gourmet spreads. My role will be as the account developer. I'm new to this business and I'm unfamiliar with putting together a proper contract. What is the industry standard in regards to what percentage each partner receives in profits?

Hello Jose,

I know of no specific industry standary save for the handshake agreement between the two of you.

Since the caterer is providing a service (producing the food), perhaps it would be fair for you to take the larger share, say 60/40. Or, since as account developer, your role may be more of a salesperson. In that case, you may want to suggest a commission based on sales.

You need a lawyer!
There are no standard precentages. It will be what you mutually agree to.
I suggest you contact www.WiseCouncilPress.com and purchase their booklet on partnerships. It is written in English (not Legalese) and it will help you understand what you need to agree to in order to be protected and you remuneration.
Are you comfortable walking out of the kitchen and the manufacture of the product line and stepping into the role of salesman?
